Terms of Individual Membership

LEAP LIKE A SALMON LIMITED – TERMS OF INDIVIDUAL MEMBERSHIP

This page (together with our Privacy Policy and our Website Terms of Use) gives you information about us and the legal terms and conditions (“Terms”) on which we provide membership to you (“Membership”) so that you can use, and benefit from, the services we provide (“Services”) on our website https://www.leaplikeasalmon.com/ (“our site”).

Please read these Terms (including our Privacy Policy and Website Terms of Use) carefully and make sure that you understand them, before applying for Membership. By applying for Membership you agree to these Terms. If you refuse to accept these Terms, you will not be able to apply for Membership.

  1. Information About Us
    • Our site is operated by Leap Like A Salmon Limited (“we”, “our”, “us”). We are registered in England and Wales under company number 07033707 and our registered office is c/o PPI Accountancy Limited, Horley Green House, Claremount, Halifax, HX3 6AS.

  2. Membership Application
    • Our site will guide you through the steps you need to take to apply for Membership. Our application process allows you to check and amend any errors before submitting your application to us. Please take the time to read and check your application before submitting it to us.
    • After you submit your application, you will receive an e-mail from us acknowledging that we have received your application. However, please note that this does not mean that your application has been accepted. Our acceptance of your application will take place as described in clause 3.
    • We will confirm our acceptance to you by sending you an e-mail that confirms that your application has been accepted (“Confirmation”). The contract between us will only be formed when we send you the Confirmation.
    • Membership entitles you to make use of the Services for domestic and private use only. If you are a business, including a sole trader, then you must apply for corporate membership, which is governed by separate terms of membership [INSERT AS LINK].
    • We will use reasonable endeavours to provide you with the Services. However, we reserve the right to vary, amend or withdraw any Services at our discretion and to suspend or terminate the Services if you are in breach of these Terms.
    • By applying for Membership you warrant and represent that:
      • you are not a minor; and
      • the details you provide in your application and at any time during your Membership are accurate, complete and not misleading.
    • During your Membership, you must inform us promptly of any relevant changes to the information you submit to us as part of your application by sending us an e-mail to info@leaplikeasalmon.com.
  3. Cancellation of Membership
    • You can always cancel your Membership. Your rights when you cancel your Membership will depend on the circumstances surrounding your cancellation as further detailed in these Terms.
    • If you are cancelling your Membership for a reason set out at 2.1 to 3.2.5 below your Membership will end immediately and we will refund you in full and you may also be entitled to compensation. The reasons are:
      • we have told you about an upcoming significant change to the Services or these Terms which you do not agree to;
      • we have told you about an error in the price or description of the Services and you do not wish to proceed;
      • there is a risk that the supply of the Services may be significantly delayed because of events outside our control;
      • we have suspended supply of the Services for technical reasons, or notify you we are going to suspend them for technical reasons, in each case for a period of more than 30 days; or
      • you have a legal right to cancel your Membership because of something we have done wrong.
    • You may have a right to change your mind in respect of your Membership under the Consumer Contracts Regulations 2013.
    • You have the right to cancel your Membership within 14 days of the Confirmation. However, if you cancel after we have started the Services, you must pay us for the Services provided up until the time you tell us that you have changed your mind.
    • If you do not have any rights to cancel your Membership, you can still contact us before its expiry and tell us you want to cancel it. Your Membership will not end until one month after the day on which you contact us. We will refund any advance payment you have made for Services which will not be supplied to you.
    • If you wish to cancel your Membership, please e-mail us at info@leaplikeasalmon.com.
    • We will refund you by the method you used for payment within 14 days of your telling us you have changed your mind. However, we may deduct from any refund an amount for the supply of the Services for the period for which they were supplied, ending with the time when you told us you had changed your mind. The amount will be in proportion to what has been supplied, in comparison with the full coverage of the Membership.
    • We may cancel your Membership if:
      • you do not make any payment to us when it is due and you still do not make payment within 14 days of us reminding you that payment is due; and/or
      • you do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to supply the Services.
    • Your Membership is not renewed automatically. You will be reminded one month before your Membership is due to expire and asked if you wish to renew. The reminder will be in the form of an e-mail, which will provide a link to allow you to renew your Membership for another year by paying a further annual subscription fee.
  4. Membership Subscription Fees
    • All Memberships are subject to an annual subscription fee as detailed in our application process.
    • We use our best efforts to ensure that the annual subscription fee detailed in our application process is correct. However, the amount of the subscription fee will not be binding on us until we have issued the Confirmation.
    • Once we have issued the Confirmation, please pay your subscription fee via our online payment facility which you can access here [INSERT AS LINK TO PAYMENT FACILITY].
    • If you do not make any payment to us by the due date we may charge interest to you on the overdue amount at the rate of 4% a year above the base lending rate of HSBC Bank plc from time to time. This interest shall accrue on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You must pay us interest together with any overdue amount.
  5. Our Responsibility for Loss or Damage Suffered by You
    • If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking our contract with you or our failing to use reasonable care and skill. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen.
    • We only supply the Services for domestic and private use. If you use the Services for any commercial or business purpose then our terms of corporate membership apply [INSERT AS LINK].
  6. General
    • We may amend these Terms from time to time. The Terms in force at the time of your application or renewal of Membership will apply to the contract between you and us.
    • These Terms and any document referred to in them constitute the entire agreement between you and us and supersede and extinguish all previous agreements, promises, assurances, warranties, representations and understandings between us, whether written or oral, relating to its subject matter.
    • We may transfer our rights and obligations under these Terms to another organisation, but this will not affect your rights or our obligations under these Terms. You may only transfer your rights or your obligations under these Terms to another person if we agree in writing.
    • These Terms are between you and us. No other person will have any rights to enforce any of the Terms, whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
    • If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.
    • These Terms are governed by English law and you can bring legal proceedings in respect of the Services in the English courts. If you live in Scotland you can bring legal proceedings in respect of the Services in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the Services in either the Northern Irish or the English courts.
